This privacy policy (this "Policy") describes how Handyman Chat, LLC, a Virginia limited liability company, and its affiliates and subsidiaries ("Handyman Chat," "we," "us," or "our") treats information collected or provided in connection with transactions, activities, and data gathered when a user ("you" or "User") visits or uses the Handyman Chat Platform (as defined below). The Handyman Chat Platform is an online community where Users can find, connect, and work with various skilled laborers for everything from home repairs to home installation projects. In addition, the Handyman Chat Platform makes locating, communicating, and scheduling easy and efficient. This Policy is intended to inform you of our policies and practices regarding the collection, use, and disclosure of information submitted to us or collected through your use of email, text message, telephone, Wireless Application Protocol (WAP), Mobile Application, Mobile Device, or other electronic means on the Handyman application for iOS, Android, or its website and various subpages (collectively, the “Handyman Chat Platform” or “Platform”).This Policy is incorporated by reference into the Terms & Conditions. Any capitalized terms used and not defined in this Policy have the meaning given to them in the Terms & Conditions.

Please note that any use of the Handyman Chat Platform constitutes your acceptance of this Policy. If you do not agree with any part of this Policy, please do not visit or use the Handyman Chat Platform. The Handyman Chat Platform is only intended for use in the United States, and the personal information you provide us as a User will be stored in the United States.

This Policy may be updated from time to time for any reason; each version will apply to information collected while it was in place. We will notify you of any material changes to this Policy by posting the new Policy on our Platform. You are advised to consult this Policy regularly for any changes. By using or accessing the Handyman Chat Platform you are accepting the practices described in this Policy. Activities that are subject to this Policy are also subject to our Terms & Conditions.

CONSENT

By accessing and using the Handyman Chat Platform, you agree that you have read and understand this Policy, and that you accept and consent to Handyman Chat’s privacy practices described in this Policy.

CONTROLLER

Handyman Chat is the controller and responsible for your personal data. If you have any questions about this Policy, including any requests to exercise your legal rights as set forth below, please contact us using the details set out below.

1.  Personal Information Collected on the Handyman Chat Platform

Because we respect your privacy rights, we are committed to our policies established for the collection and/or use of your “Personal Information,” which is hereby defined as full name, username, postal address, phone number, email address, age, birth date, social media, and any information that could be used to identify, contact, or locate you directly without using the Handyman Chat Platform.

By using the Handyman Chat Platform, you are authorizing us to collect, parse, and retain data related to the provision of the Handyman Chat Platform. However, we also provide Users with options and choices regarding how we use and disclose some or all of your Personal Information, as set forth specifically below, including how to access, correct, and/or remove it. You may avoid further said data collection by uninstalling the App from your mobile device and not otherwise using the Handyman Chat Platform.

When you visit or use the Handyman Chat Platform, we automatically collect certain types of information about you. Handyman Chat’s servers automatically gather data about how the Site or App is accessed and utilized ("Usage Information"). Usage Information includes, but is not limited to, IP addresses, browser type, domain information, operating system, the page served, the time, the former and following page visits, and advertisement material selected. This factual information furnishes us with data about the utilization of the Handyman Chat Platform, for example, what number of guests visits a particular page on the Platform, to what extent they remain on that page, and which hyperlinks, if any, they "click" on. This collection of data allows us to keep our Platform new and user-friendly for you.

Some of the additional categories of automatic data we collect that is furnished by you, but does not personally identify you, include the following:

  1. Transaction Information: We collect transaction details related to your use of the Handyman Chat Platform, such as type of service requested, date and time of service, amount charged, distance traveled, your search queries on the Platform, ratings and reviews, and other related transaction details. 
  2. Handyman Chat Payment Method: When you add a credit card or other payment method to your Handyman Chat account, a PCI compliant third party that handles payments for us will receive your card information. To keep your financial data secure, we do not store full credit card information on our servers.
  3. Customer Support: We may collect information through your communications with our customer-support team.
  4. Device Information: We may collect information about your mobile device, including the following examples: the hardware model, operating system/version, software names/versions, file names/versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
  5. Log Information: When you interact with the Handyman Chat Platform, we collect server logs, which may include device IP addresses, access dates and times, app features or pages viewed, app crashes and other system activity, browser type, and the third-party site/service accessed immediately prior to interacting with the Handyman Chat Platform.
  6. Location Information: The Platform collects real-time information about the location of your device; however, this feature can be turned off or deactivated by configuring the location services settings on your device.

You may provide information to be published or displayed (”Posted”) on public areas of the Handyman Chat Platform (collectively, “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. We cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

2.  Use of Information

We are conscientious of protecting the Personal Information you share with us, and we have in place sensible security measures to ensure the safety of your Personal Information. We only use your Personal Information for Handyman Chat Platform related purposes (this includes the information collected by our third-party service providers, set forth herein).

Specifically, the purposes of our “use” include platform analytics, marketing, advertising, and other purposes designed to help us efficiently operate and improve the Handyman Chat Platform in any of the following manners

  • to contact you in connection with your Handyman Chat-related activities (including, but not limited to, confirmation emails, account verification text messages, push notification alerts, or important alerts that could affect your relationship with Handyman Chat),
  • for identification and authentication,
  • for security and fraud prevention,
  • to confirm your identity,
  • to investigate potential unauthorized use of your information,
  • to communicate service requests from you to other Users, 
  • to suggest potential customers for your services,
  • to advertise, promote, and market Handyman Chat services and products, and/or
  • to continuously evaluate and improve the online and mobile User experience.

3.  Advertising and Advertising Opt-Out Provisions

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

·       Tracking Technologies and Advertising: You can set your device to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Platform may then be inaccessible or not function properly.

·       Disclosure of Your Information for Third-Party Advertising: If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by sending us an email stating your request to info@handymanchat.com 

·       Promotional Offers: If you do not wish to have your email address or contact information used by the Company to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to info@handymanchat.com If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.

·       Targeted Advertising: If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by visiting  https://adssettings.google.com Settings page. Please note, we do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the NAI on the NAI's website. See the link above.

You may also be able to change your mobile device settings to opt out of personalized advertising through apps. For example, for iOS mobile devices, go to “Settings” from your device’s home screen; scroll down to “Privacy”; select “Advertising”; and turn on “Limit Ad Tracking.” Also, for location-based ads, you may go to “Settings” from your device’s home screen; select “Privacy”; select “Location Services”; select “System Services”; and de-select “Location-Based Apple Ads.”  For Android mobile devices, go to “Google Settings” on your device; select “Ads”; and check the box labeled “Opt Out of Interest-Based Ads.”

Please note that when you opt out of personalized advertising, you may continue to see online advertising on the Handyman Chat Platform and/or our ads on other Internet websites.

We may anonymize or aggregate data collected through the Handyman Chat Platform and use it for any authorized purpose.

4.  Disclosure of Information to Others

When you use the Handyman Chat Platform, our third-party partners, such as ad networks and analytics providers, use tracking technologies to collect information about how the Handyman Chat Platform is used and about the devices used to access the Handyman Chat Platform. Our partners also may collect information about your online activities over time and on other websites or apps. When our third-party partners provide such features, they are governed by the privacy policies of their governing organizations. You may be able to change browser or app settings to block and delete these technologies when you access the Handyman Chat Platform, but that might interfere with the Handyman Chat Platform’s proper functioning.

To operate the Handyman Chat Platform, including processing your transactions and supporting your activities on the Handyman Chat Platform, we may share your Personal Information with vendors, agents, and third-party service providers in exchange for their support services like email origination, receipt/support services, and other user relationship management services.

As set forth herein, we do not rent, sell, or share Personal Information about you with other people or non-affiliated companies for their direct marketing purposes unless we have your permission. We may allow access to other data collected by the Handyman Chat Platform to enable the delivery of our online advertising on the Handyman Chat Platform and on other websites and online services, or to send you information we think may be useful or relevant to you. The following are examples of how we share your information with third-party service providers.

·    Data Analytics: We retain third-party service providers to help us perform data analytics regarding your interactions with the Handyman Chat Platform. For example, we use Google Analytics Service for purposes of analyzing usage of the Handyman Chat Platform. ·    Payment Processing: We use a third-party payment processor to process any billing information between Users and us, including credit card information Users submit. You can find information about such third-party processor’s privacy practices at the processor’s web page or by contacting such processor directly.

·    Other Users: When you create a User profile, the profile may display certain information about you to other Users, including, without limitation, your name, photograph, geo-location, job site location and photographs, and rating.

·    Social Networking and Other Websites: The Handyman Chat Platform may allow you to share information, including Personal Information, with social networking websites, such as Facebook, Google, etc. Except for our marketing and advertising purposes, we do not share your Personal Information with them unless you specifically authorize it. If you choose to log in to the Handyman Chat Platform through social networking websites, we may share information about your account with the social networking site. Their use of the information will be governed by their privacy policies, and you may be able to modify your privacy settings on their websites.

·    Legal and Similar Disclosures: We may access, preserve, and disclose collected information, if we believe doing so is required or appropriate in the following situations: to comply with law enforcement requests and legal process, such as a court order or subpoena; to respond to your requests; or to protect your, our, or others' rights, property, or safety. We may also disclose your Personal Information as part of a dispute among Users or between Users and Handyman Chat as well as to an attorney in the process of obtaining legal advice.

·    With Your Permission: We may also disclose your Personal Information with your permission as set forth herein.

·    Research and Development: We may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the safety and security of our services, develop new features and products, and facilitate insurance and finance solutions in connection with our services.

5.  Information Collected by Cookies and Other Technologies

Like most online services and mobile applications, we and our third-party service providers may use cookies, web beacons, and similar tracking technologies to collect information about your activity from the computer or devices you use to access the Handyman Chat Platform. A cookie is a file saved on a user’s hard drive that stores certain information about user activity. Users must agree to let cookies be saved for them, and most web browsers are set to accept cookies by default. Although you can modify your browser/device settings to reject cookies if desired, this could potentially affect the availability and functionality of our Platform.

Any third party with whom we are allowed to share your Personal Information is authorized to use your Personal Information in accordance with our contractual arrangements with such third parties and in accordance with their own privacy policies, over which we have no control. You agree that we are not responsible or liable for any of their actions or omissions. Those who contact you will need to be instructed directly by you regarding your preferences for the use of your Personal Information by them.

6.  How to Edit Your Personal Information

You can review and change your Personal Information by logging onto the Platform and visiting your account profile page.

You may also send us an email at info@handymanchat.com to request access to, correct, or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your User account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User contributions from the Platform, copies of your User contributions may remain viewable in cached and archived pages or might have been copied or stored by other Platform Users. Proper access and use of information provided on the Platform, including User contributions, is governed by our Terms & Conditions.

7.  Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your Personal Information. To learn more about your California privacy rights visit https://www.caprivacy.org/.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits Users that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. 8.  Your Legal Rights

You have the right to any of the following at any time:

  • Request access: to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.
  • Request correction: of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure: of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully, or where we are required to erase your Personal Information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons, which will be notified to you, if applicable, at the time of your request, and that erasure may result in your inability to use or access the Platform. 
  • Object to processing: of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation that makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information that override your rights and freedoms.
  • Request restriction: of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios:

1.     If you want us to establish the data's accuracy.

2.     Where our use of the data is unlawful, but you do not want us to erase it.

3.     Where you need us to hold the data even if we no longer require it as you need it to establish, exercise, or defend legal claims.

4.     You have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use it.

  • Request the transfer: of your Personal Information to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information that you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time: where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

9.  Information Retention

To preserve the integrity of our databases, standard procedure calls for us to retain information submitted by Users for an indefinite length of time. You agree that we may store the information we collect for this indefinite length of time. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information, and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

10.  Children's Information

The Platform is not intended for persons under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. 11. Our Security Precautions

Only you and authorized Handyman Chat employees have access to your account information. In order to maintain this protection, do not give your password to anyone. Handyman Chat staff will never proactively reach out to you and ask for any personal account information, including your password. If you share a computer or mobile device, in order to protect your information entered on public terminals from disclosure to third parties, you should sign out of your Handyman Chat account and close the browser window before someone else logs on. Handyman Chat has security measures in place intended to help protect against the loss, misuse, and alteration of the information under our control.

International: Your information may be transferred to and maintained on computer networks that may be located outside of the state, province, or other governmental jurisdiction in which you reside; and the privacy laws governing the country/jurisdiction of these computer networks may be less protective.

Handyman Chat takes steps to ensure that your information is secure on its system. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Handyman Chat cannot guarantee the security of any information you transmit to us, and you do so at your own risk. HANDYMAN CHAT EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING, OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION OR USAGE INFORMATION AND FURTHER DISCLAIMS ANY LIABILITY THAT MAY ARISE SHOULD ANY OTHER INDIVIDUALS OBTAIN THE INFORMATION YOU SUBMIT TO THE PLATFORM.

12.  Links to Third-Party Websites and Online Services

This Policy applies solely to information collected by the Handyman Chat Platform. The Handyman Chat Platform may contain links to other websites, charitable organizations, or online services; and we of course are not responsible for other websites’ privacy practices. We advise Users upon leaving the Handyman Chat Platform to carefully review the privacy statements of any website that collects personally identifiable information.
